AstraZeneca's Nexium (Esomeprazole) has lost patent protection for a dose of the drug.
Nexium was launched in Europe in September 2019 and is now awaiting final approval from the US Food and Drug Administration (FDA) for its equivalent of the drug in the United Kingdom.
Nexium is used to treat frequent heartburn (occurs 1 or more days a week), acid reflux (occurs 1 or more days a week), and other stomach problems.
The drug has been on the market in 20 years, and it was originally patented in 2001 for acid reflux medication. The drug is known as Zantac, which is one of the most popular branded versions in Europe.
It is used in people with chronic conditions such as high blood pressure or heart disease.
It can be taken by mouth or by swallowing.
Nexium is the only drug approved by the FDA to treat heartburn. Other approved drugs are also available, but they have been withdrawn from the market after concerns about heart damage linked to the drug.
AstraZeneca has filed a with the US Food and Drug Administration to bring the generic versions to market. The drug is currently in an interim status in Europe.
The Nexium patent has been in force since 2001. It was first patent protected in 1996.
The drug's patent for acid reflux medication has also been in force since 2001.
However, AstraZeneca and other drug manufacturers are unlikely to sue the company in court if the drug is found to have an adverse effect on the heart.
Patents in other countries have also been invalidated. These countries include Australia, Canada, Denmark, Greece, Finland, Ireland, France, Germany, Italy, Luxembourg, Norway, New Zealand, Spain, Sweden, Switzerland, United Kingdom, United States, and the Netherlands.
AstraZeneca, Nexium patent expiredIn the US, AstraZeneca filed a similar lawsuit on the grounds that Nexium would be subject to invalidation. This is because the US Food and Drug Administration (FDA) is not yet aware of the drug's patent for Nexium.
The FDA does not currently have a ruling on whether the drug is safe for people with heart problems, so it has not yet issued any ruling on the issue.
Pfizer is the first drug manufacturer to file a patent in the US. However, the pharmaceutical company is still not yet aware of the Nexium patent, so it may sue for invalidity.
Pfizer had filed a lawsuit against AstraZeneca in 2015 for an alleged infringement of its Nexium patent. The lawsuit was filed in the US District Court for the District of Massachusetts in 2015.
AstraZeneca, Nexium patentAstraZeneca is currently seeking approval of its generic version of Nexium to treat heartburn. The US Food and Drug Administration (FDA) has not issued a ruling on the issue.
In April 2018, AstraZeneca filed a lawsuit against the US Patent and Trademark Office for an alleged infringement of its patent for Nexium. The lawsuit was filed in the US District Court for the District of Massachusetts.
